يتابع مركز النماء لحقوق الانسان ببالغ القلق تسارع اعمال العنف في محافظة البصرة على اثر التظاهرات التي انطلقت مؤخرا في المحافظة ضد الظلم والتمييز للمطالبة بالحقوق وابسطها الحق بالحصول على مستوى معيشة لائق، ونعبر عن اسفنا الشديد لاستخدام العنف المفرط من قبل بعض الاجهزة الحكومية الأمنية (قوات فض الشغب وقوات سوات) وأيضا المجاميع المسلحة غير المنضبطة تجاه المحتجين وازدياد حالات الجرحى والمصابين والشهداء.
ويعرب المركز عن قلقه إزاء استمرار الحكومة باتخاذ موقف سياسة التخويف والترهيب وممارسة القوة في قمع حرية التعبير عن الرأي ووضع محددات امام هذا الحق المقدس والتقصير في حماية واحترام الحق بالتعبير عن حرية الراي والحق بالتجمع السلمي.
نحن نتابع بقلق انتشار الاشاعات المغرضة واستخدام صور وافلام قديمة و غير دقيقة عبر وسائل التواصل الاجتماعي تم رصدها لتشويه الحقائق عن التظاهرات، ويراقب مركزنا بحذر اهمال سير إجراءات تقاضي عادلة وشفافة بحق مرتكبي العنف من القوات الأمنية لمنع تكرارها.
ونؤكد ان الحق بالتظاهر السلمي وحرية التعبير عن الرأي والتجمع السلمي مكفول ومصون في الدستور العراقي لسنة ٢٠٠٥ في باب الحريات المادة (٣٨) كما ضمنت التشريعات الدولية هذا الحق منذ الاعلان العالمي لحقوق الانسان سنة ١٩٤٨ في المادة (١٩) إضافة الى ما جاء في المادة (١٩) والمادة (٢١) أيضا من العهد الدولي الخاص بالحقوق المدنية والسياسية لسنة ١٩٦٦ لضرورة الاعتراف بهذا الحق الأصيل .
وبهذا الصدد فان مركز النماء لحقوق الانسان يدعو منظمات المجتمع المدني المعنية والفرق الطوعية بتقديم خدمات الدعم النفسي والقانوني للمصابين والجرحى ورصد توثيق قصصهم وعرضها على الرأي العام ويدعو الحكومة العراقية الى:
１- وقف فوري للأعمال العدائية والنظر الى مطالب المحتجين بجدية وتلبيتها وعدم التسويف والمماطلة واحترام الحق بحرية التعبير عن الرأي والتظاهر عدم وضع قيود تجاهه (الا تلك التي تفرض طبقا للقانون وتشكل تدابير ضرورية، في مجتمع ديمقراطي، لصيانة الأمن القومي أو السلامة العامة أو النظام العام أو حماية الصحة العامة أو الآداب العامة أو حماية حقوق الآخرين وحرياتهم ) وكما ذكرت في قوانين حقوق الانسان الدولية .
２- توجيه الأجهزة الأمنية المتواجدة والمكلفة بمراقبة التظاهرات بالتهدئة وعدم استخدام الرصاص الحي والغازات المسيلة للدموع المنتهية الصلاحية والمحرمة دوليا.
３- إيقاف تتبع وتعقب النشطاء وعدم الاعتقال التعسفي والإخفاء القسري للمعتقلين ومعاقبة وفضح الجهة التي تقوم بذلك بأشد العقوبات.
４- ان تسهل الوزارات ذات العلاقة للمختطفين والمعتقلين المتعرضين للتعذيب جراء التظاهرات اجراء دعاوى مباشرة بحق الأجهزة الأمنية وقادتها ومرتكبي هذه الافعال.
５- تشكيل لجنة مستقلة لغرض فتح تحقيق وكشف ملابسات حالات الاعتداء المتكرر والاعتقالات والخطف ضد منظمي التظاهرات في العراق ومحاسبة المتورطين.
６- تقديم خدمات صحية مثل عمليات التجميل من قبل وزارة الصحة وبشكل مجاني لمن تعرض الى ندوب واثار تعذيب او اصابات جراء اشتراكه في التظاهرات.
７- عقد لقاءات واجتماعات مع فئات المجتمع المختلفة لغرض الاخذ برأيهم لتحسين سريع للخدمات العامة في المحافظة بما يؤمن حياة لائقة وكريمة وآمنة لسكان البصرة بعد المعاناة الكبيرة التي عاشوها.
ختاما يعلن المركز نيابة عن جميع المدافعينات عن حقوق الانسان ونشطاء المجتمع المدني عن خالص مواساتنا وتعازينا لعوائل ذوي الضحايا ودعواتنا بالشفاء العاجل لجميع الجرحى والمصابين في هذه الاحداث ويشدد على دعوة جميع المتظاهرين لضرورة ممارسة هذا الحق بسلمية والحفاظ على الممتلكات العامة ويشيد كذلك بدور خروج النساء ومشاركتهن الفاعلة في هذه التظاهرات وأثره البالغ على دعم مسيرة المطالبة بالحقوق والمساواة والعدالة في العراق.

Statement by Al-Namaa Centre for Human Rights
Present Calamities in Basra
Al-Namaa Center for Human Rights is anxiously tracking the acceleration of violent practices against the demonstrations in Basra which erupted lately against Injustice and discriminations and demanding basic rights such as modest living standard. We voice here our deep regrets for the use of extreme violence by some of the state security forces (Anti-Riots and SWAT forces) and the uncontrolled paramilitary groups against the protesters which led to many casualties; injuries and death amongst civilians.
Al- Namaa Center expresses its concerns over the continued terrorising practices and the use of force to curtail freedom of speech, apply limiting rules against this right and the disregard to their duty in the protection of the right to speech and peaceful rallies.
We continue to monitor, with anxiety, the wide-spread of provocative rumors and the use of old and inaccurate videos and photos on the social media platforms to undermine the demonstrations. Our Center is monitoring the negligence in taking the necessary transparent and just legal process against the perpetrators of violence from the security forces to prevent its occurrence in the future.
We stress here the right to peaceful demonstrations and rallies and freedom of speech guarantied by the Iraqi Constitution of 2005 (Freedoms: Article 38). The International Law have also guarantees this right since the issue of the Human Rights Declaration in 1948, article 19 in addition to Articles 19 and 21 of the International Covenant on Civil and Political Rights of 1966 for the application of this right in Iraq.
In this regard, Al- Namaa Center for Human Rights calls upon all civil society organizations and voluntary teams to provide psychological and legal support to the casualties. In addition we call upon them to monitor and document the painful stories for the world to see.
We call upon the Iraqi government to:
- Immediate stop to the use of force against the protesters, respond to their demands without delay and respect their freedom of speech without limitation (Except in accordance with the law as a precautionary measure, in a democratic society to protect national security, public safety, public order or to protect public health, or protecting others’ rights and freedom) and in accordance with International Human Rights conventions.
- Direct the security forces, which are deployed to monitor the demonstrations, to exhibit restraint and order them to stop the use of internationally prohibited tear gas and live ammunition.
- Stop tracking down the activists, violent arrests and forced disappearances of the detainees, and by punishing and exposing the groups responsible for those violations.
- For the relevant Ministries to facilitate direct legal action against the security forces and their commanders by those who were forcibly disappeared, arrested or tortured because of their participation in the demonstrations.
- Form an independent committee to investigate and expose the frequent violations, the kidnapping and the arrest of the organisers of the demonstrations and, put on trial those involved
- Provide health services like plastic surgeries for those whose who were scared due to the extreme torture.
- Arrange meetings with the various social groups and listen to their demands and consult with them for a quick and better improvement of public and fundamental services to secure a safe and convenient life to the people of Basra after living through horrific conditions.
- Establish independent committee to investigate speedily the killing of the demonstrators to expose the perpetrators
Finally, on behalf of all the defenders of Human Rights and the civil society activists, Al-Namaa Center expresses its sympathy and condolences with the families of the wounded and the victims. Our best wishes to the wounded for speedy recovery. We call upon all the protesters to use their rights for peaceful protest and the preservation of public property. We commend the role of women and their participation in these demonstrations which has great effect on drive to demand equality, justice and rights in Iraq.
